By accessing or using TogetherWeRise ("we," "us," or "our") services, including our website at togetherwerise.com and related applications (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you may not access or use the Service. We may update these Terms from time to time, and your continued use of the Service constitutes acceptance of any changes.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into a binding agreement
• You are not prohibited from using the Service under applicable laws
• Your use will comply with these Terms and all applicable laws and regulations

3. Account Registration

To access certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4. Service Description

TogetherWeRise provides a platform connecting music artists with industry curators for demo submissions and feedback. The Service includes:

• For Artists: Upload demos, receive professional feedback, connect with curators
• For Curators: Review submissions, provide feedback, earn compensation
• Credit System: Purchase and use credits for submissions
• Feedback Guarantee: 7-day response guarantee with credit refund

5. User Content

You retain ownership of content you upload to the Service ("User Content"). By uploading User Content, you grant TogetherWeRise a limited license to:

• Store and process your content to provide the Service
• Share your submissions with selected curators for review
• Create audio fingerprints for copyright protection purposes

You represent and warrant that you own or have the necessary rights to all User Content you upload, and that your content does not infringe any third-party rights.

6. Prohibited Conduct

You agree not to:

• Upload content you do not have rights to
• Infringe on any intellectual property rights
• Upload harmful, fraudulent, or illegal content
• Harass, abuse, or harm other users
• Attempt to circumvent any security measures
• Use automated systems to access the Service without permission
• Misrepresent your identity or affiliation
• Violate any applicable laws or regulations

7. Payments and Credits

The Service uses a credit-based system for submissions:

• Credits are purchased through our payment provider (Stripe)
• Credits are non-refundable except as specified in our Refund Policy
• If a curator fails to respond within 7 days, credits are automatically refunded
• Curator payouts are processed weekly via Stripe Connect

8. Curator Terms

If you register as a curator, you additionally agree to:

• Complete reviews within 7 days of receiving submissions
• Provide honest, constructive feedback
• Maintain professional conduct in all interactions
• Not share submission content outside the platform
• Comply with our Curator Guidelines

9. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of TogetherWeRise and its licensors. Our trademarks and trade dress may not be used without prior written consent.

10. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may delete your account at any time. Upon termination, your right to use the Service will cease immediately. Unused credits may be forfeited upon voluntary account deletion.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOGETHERWERISE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

13. Governing Law

These Terms shall be governed by the laws of England and Wales, without regard to conflict of law principles.

For users in the European Union, nothing in these Terms affects your rights under applicable consumer protection laws.
